Redken “Fashion Insider” Contest

NO PURCHASE NECESSARY

  1. HOW TO ENTER:  The Redken “Fashion Insider” Contest (“Contest”) starts at 12:01 am Eastern Time (“ET”) on 02/01/2008 and ends at 11:59:59 pm ET on 05/31/2008 (“Contest Period”). To enter, visit www.redken.com/fashioninsider (“Website”) during the Contest Period and submit two (2) separate essay answers to the essay questions posted on the Website of 250 words or fewer each in the space provided  along with one (1) photograph of your style icon (collectively, “Submission”).  Submissions must be in the English language and must be received before 11:59:59 p.m. ET on 05/31/2008. Along with the Submission, you must also complete the online entry form by providing your complete name, street address (no P.O. Boxes), city, state, zip code, gender, date of birth (mm/dd/yyyy), and email address.  Incomplete Submissions or Submissions that contain an image or information that is deemed to be lewd, profane or otherwise offensive will be disqualified, as determined solely by Sponsor. By entering, all Submissions become the property of Sponsor and will not be acknowledged or returned. By submitting a Submission, each entrant warrants and represents that (i) the Submission is original to the entrant and created solely by entrant, (ii) neither the Submission nor any part thereof shall infringe upon or violate the rights of any third party; and (iii) each entrant grants to Sponsor the perpetual, unlimited and irrevocable right to post, publish and/or otherwise use the Submission in any manner and in any media now known or hereafter developed. Limit one entry per person and per email address. Employees and agents of L’Oréal USA, Inc. (“Sponsor”) and Arrowhead Promotion & Fulfillment (“Administrator”), their respective parent companies, affiliates, subsidiaries, divisions, brands, and advertising and promotion agencies are not responsible for incorrect or inaccurate entry of information or for those who cannot access the Internet or cannot click-through for any period of time regardless of technical, hardware, software, telephone, Internet, virus contamination, network problems or delay, failure or malfunction for any reason. Personal information collected from entrant is used only for the purpose to notify the winner, and will not be re-used, sold or shared in any manner by Sponsor, Administrator, or any third parties, unless entrant has checked the box that appears on the online entry form, and opts to receive news and offers about Redken products.  Once the Contest has ended, all information supplied by entrants who do not agree to receive such information will be removed from the database.    
  2. PRIZE: One (1) Grand Prize winner.  .  A 6-day/5-night, trip for two (2) to New York City to attend Fashion Week, in September 2008.  The trip includes: two (2) round-trip coach class air transportation from a major airport closest to the winner’s home to New York City; 5-nights hotel accommodation (standard room, double occupancy), ground transportation to/from shows/hotel/airport, one backstage pass to Redken led Fashion Shows, a laptop computer, a digital camera, and $1,000. spending money, awarded in the form of a check. As a condition of receiving the Grand Prize, Grand Prize Winner must attend all Redken backstage prep with confirmed access to Redken led Fashion Shows and must blog about the experience every day there are shows. Winner must represent Redken at shows in behavior and demeanor.  Winner must abide by Redken’s blog guideline/rules which will be provided to the winner prior to their fashion week travel.  Redken is not responsible for winner’s free time.  Dates and schedules may change at Redken’s discretion.  Grand Prize Approximate Retail Value (“ARV”): $6,300.00.  Actual retail value of the Grand Prize may vary due to airfare, any difference between the stated ARV and actual ARV will not be awarded.  Grand Prize Winner must travel on dates specified above by Sponsor, which are subject to change.  Certain restrictions may apply.  Any portion of the prize not accepted by the winners will be forfeited.  All expenses not specified herein, including but not limited to miscellaneous hotel expenses, meals, ground transportation, taxes and gratuities are the sole responsibility of Grand Prize winner.  Void where prohibited or restricted by law.  No substitution or transfer of prize permitted except at Sponsor’s sole discretion.  Prize not redeemable for cash.  All federal/state/local taxes are the sole responsibility of Grand Prize winner.  Winner will be sent an IRS Federal 1099-MISC tax form for the retail value of any prize at or above $600. Sponsor reserves the right to substitute prize of equal or greater value if an advertised prize becomes unavailable, or for any other reason at Sponsor’s sole discretion.  No substitution, cash equivalent or transfer of prize by Grand Prize winner is permitted.   
  3. ELIGIBILITY:  Open and offered to legal residents of the 50 United States or District of Columbia, who are 21 years of age or older as of 02/01/2008.  Employees and agents of Sponsor, Arrowhead Promotion & Fulfillment, their parent company, affiliates, subsidiaries, advertising, divisions, brands and promotion agencies, their immediate families (spouse, parents, children, and siblings and their respective spouses) and individuals living in the same households of such persons are ineligible to enter or win. Void in Puerto Rico and Canada and where prohibited by law.   Subject to all applicable federal, state and local laws.  By participating, entrants agree to be bound by these Official Rules and accept decisions of the Sponsor as final in all matters relating to this contest.  Proof of mailing entry does not constitute proof of delivery.   
  4. JUDGING:  Round 1: On or about 6/11/2008, all eligible Submissions will be judged by an independent judging organization. Each submission will be judged based on the following judging criteria and percentages: (i) originality (30%); (ii) portrays personality (30%); (iii) persuasiveness (20%); and (iv) creativity (20%). The top ten (10) highest scoring Submissions will then be deemed Semi-Finalists. In the event of a tie, the Submission with the highest score in the originality criterion for the essay will be deemed the Semi-Finalist from among all Submissions with which it ties. Round 2: On or about 6/18/2008, each Semi-Finalist will be notified by phone or mail that they are a Semi-Finalist and will then schedule a telephone interview with Sponsor. In the event Sponsor is unable to contact a potential Semi-Finalist within forty-eight (48) hours from the start of attempted notification, that Semi-Finalist will be disqualified, and the next highest-scoring alternate Semi-Finalist will take the original potential Semi-Finalist’s position. The Semi-Finalists will be judged based on the following judging criteria during that telephone interview, based on the Semi-Finalist’s responses during the interview, as follows: (i) confidence (20%); (ii) ease at conversation (30%), (iii) answer questions clearly and concisely (20%); and (iv) level of interaction (20%). The top three (3) highest scoring Semi-Finalists will then be deemed Finalists. In the event of a tie, the Semi-Finalist with the highest score in the “answer questions clearly and concisely” criterion will be deemed the Finalist from all Semi-Finalists with whom he/she ties. Round 3 On or about 7/1/08, each Finalist will be notified by phone or mail that they are a Finalist and will then schedule an in-person interview with Sponsor, at a location determined solely by Sponsor. In the event Sponsor is unable to contact a potential Finalist within forty-eight (48) hours from the start of attempted notification, that Finalist will be disqualified, and the next highest-scoring alternate Finalist will take the original potential Finalist’s position. Sponsor will be responsible for his/her transportation to the interview location.  The Finalists will be judged based on the following judging criteria and percentages: (i) comfort level with the judging team and PR team (30%); (ii) presence and charisma (10%); (iii) enthusiasm (10%); (iv) interaction with others (20%); (v) ease at conversation (20%); and (vi) ease with laptop and camera (10%).  The Finalist with the highest score will then be deemed the Grand Prize winner. In the event of a tie, the Finalist with the highest score in the “comfort level with the judging team” criterion from among the Finalists with whom he/she ties will be deemed the Grand Prize winner. 
  5. LIMITATIONS:    Sponsor, Administrator, and their respective parent, subsidiary or affiliate companies (collectively, the “Released Parties”), shall have no obligation or responsibility with regard to, and entrants release and hold the Released Parties harmless from any loss or liability resulting or arising from (i) entries that contain inaccurate information or do not comply with these rules, (ii) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind, (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties,  (iv) any inability of the winner to accept the prize for any reason; (v) if a prize cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism or weather or other cause outside the control of Sponsor; or (vi) any damages or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities (including without limitation travel to or from and participation in interviews for Round 3).  Sponsor or the Administrator, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of this contest or otherwise violating these rules.  If Sponsor or the Administrator determines, in their respective discretion, that technical difficulties or unforeseen events outside their control compromise the integrity or viability of the promotion, Sponsor reserve the right to void the entries at issue, modify the Contest and/or terminate the relevant portion of the Contest. 
  6. GENERAL CONDITIONS:  Sponsor reserves the right to disqualify any person tampering with the entry process, the operation of the Website, or who is otherwise in violation of the Official Rules.  Sponsor further reserves the right to cancel, terminate or modify the Contest in the event the Contest is not capable of completion as planned, including infection by computer virus, bugs, tampering, or technical failures of any kind.  In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed the entrant and must comply with these Official Rules.  Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address.  CAUTION: ANY ATTEMPT BY ANY ENTRANT TO DELIBERATELY DAMAGE THE REDKEN WEBSITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.  By participating, entrants agree to be bound by these Official Rules and the decision of the judges.  Winner consents to the use of his/her name and/or photograph for promotional purposes in any and all media worldwide, including  but not limited to online announcements, without additional compensation, except where prohibited by law.  Entrants agree that their entry will be owned by the Sponsor and Administrator and their designees shall have the right to publish, use, adapt, edit and/or modify such entry in any way including in commerce and in any and all media worldwide, including but not limited to the Internet, without limitation and without compensation to the entrant.  Entrants represent that their entries, and the Sponsor’s and Administrator’s use thereof, will not infringe upon the rights of any third parties. Potential Grand Prize winner must execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form within 15 days of notification.  Noncompliance/return of prize notification as undeliverable will result in disqualification and selection of an alternate winner, time permitting. Potential Guests/Travel Companions of Grand Prize Winner must also execute a Release of Liability within 15 days of notification to be eligible for travel and must be 21 years of age or older as of the date of travel.   
  7. SPONSOR & ADMINISTRATOR:  The Sponsor of this Contest is Redken 5th Avenue NYC, Professional Products Division of L’Oréal USA, Inc., 575 5th Avenue, New York, NY 10017. The Administrator of this Contest is Arrowhead Promotion & Fulfillment, 1105 SE 8th Street, Grand Rapids, MN 55744.  For name of the Grand Prize winner, available after 07/25/2008, send a separate, stamped, self-addressed, No.10 envelope to:  J. Lovering, Redken “Fashion Insider” Contest, Redken 5th Ave NYC, 565 Fifth Avenue, 3rd Floor, New York, NY 10017.  Vermont and Washington residents may omit return postage.
